Was the hearing procedurally unfair because it was not long enough to cover all of the issues?

Was the hearing procedurally unfair because it was not long enough to cover all of the issues?

Introduction

The hearing should be arranged with ample time to cover all the issues, and the family should be given equal time with the school staff to speak and present their case. Disparity in the opportunity for the parties to present their case would likely constitute an unfair process.

Next step?

Consider the records of the hearing and answer the question: Was the family given time to present their case and as much opportunity as the school to speak?

If the answer is no, consider using the Suggested Wording document: Argument to the IRP: Governing board's decision unfair (insufficient time to speak)
